Sales and Usage Terms (Store)

This is a draft version currently under legal review; changes are possible. German is the master version.

1. Scope, contracting party

These terms apply to purchases of digital content in the store of schweinerei.xyz (e-books EPUB/PDF; access to the illustrated audiobook "Playable Audio Book", PAB) between you and Porcine Hosting Solution LLC, a limited liability company under Georgian law, seated in Tbilisi, Georgia ("Provider", "we").

Sales are processed by our payment and distribution partner Paddle.com Market Limited, 30 Old Bailey, London EC4M 7AU, United Kingdom (or the Paddle entity named at checkout, "Paddle"). Paddle acts as Merchant of Record and authorised reseller: you conclude the purchase contract for the product with Paddle. Paddle Buyer Terms (paddle.com/legal/buyer-terms) and the Paddle Refund Policy (paddle.com/legal/refund-policy) govern payment, invoicing, VAT, refunds and withdrawal. In case of conflict, Paddle's terms prevail on payment/tax/withdrawal/refund matters, these terms on content, use and support. Any further rights under our money-back guarantee (see withdrawal notice) take precedence over Paddle's terms.

Mandatory statutory rights of consumers habitually resident in Germany or the European Union remain unaffected.

Pricing: all German-language editions of a title (e-book, PAB) carry one fixed, uniform final price across all sales channels. We do not offer discounts, promotional prices or vouchers.

2. Products and delivery

E-books: you receive download access to the file (EPUB and/or PDF) after successful payment. The download link is time-limited and restricted to a limited number of downloads; afterwards you can obtain renewed access on proof of your order.

PAB: access to the content (audio, image track, text) is activated after successful payment. The terms governing the duration of access are set out on the respective product page.

Activation happens automatically once Paddle confirms payment. If delayed, contact business@schweinerei.xyz.

No account is required; access is provided to you directly after purchase. Keep your access details safe; if lost, contact business@schweinerei.xyz with proof of your purchase.

3. Usage rights

You receive a simple, non-transferable right to use the content for private, non-commercial purposes (reading, listening, viewing on your own devices).

Passing on, making publicly available, reproducing beyond the private sphere and commercial use are prohibited. Statutory limitations (e.g. private copying, § 53 UrhG) remain unaffected.

No DRM, but watermarking: the files contain an individual watermark that may be linked to your order. See our privacy policy for details.

The rights holder of the content is the author; usage rights for distribution through this store are conveyed through a licence agreement between the author and the Provider.

4. Prices, payment

The final prices shown on the product page and at checkout include statutory VAT, determined and remitted by Paddle as Merchant of Record. Payment methods: those offered at checkout.

The same fixed final price applies in all German sales channels for all German-language editions (see item 1 above); we grant no discounts.

5. Withdrawal and money-back guarantee

See our withdrawal notice for consumers. Withdrawal must be declared to Paddle, or via the withdrawal function in the Paddle Customer Portal. Independently of this, you can get a refund for any purchase within 14 days without conditions, even after download or use (details there).

6. Defects / technical issues

If a file or access does not work as described, contact us first: business@schweinerei.xyz. Statutory rights for defects in digital products apply (§§ 327 et seq. BGB). If unresolved, you may contact Paddle (Refund Policy § 4).

7. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act. For slightly negligent breach of essential contractual obligations (cardinal duties – duties whose fulfilment makes proper performance of the contract possible in the first place and on whose observance you regularly rely), our liability is limited to foreseeable damage typical for this type of contract. Otherwise, liability for slightly negligent breaches is excluded. Paddle's Buyer Terms apply to the contractual relationship with Paddle.

8. Governing law, jurisdiction, dispute resolution

The relationship with Paddle is governed by Buyer Terms § 13 (English law; consumers may additionally sue in their country of residence; mandatory consumer law remains unaffected).

The relationship with the Provider is governed by the law of Georgia, excluding the CISG. For consumers habitually resident in an EU member state, this choice of law applies only insofar as it does not deprive them of protection under mandatory provisions of the law of their country of residence (Art. 6(2) Rome I Regulation).

We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board. No reference to the EU Online Dispute Resolution platform is made, as it was discontinued on 20 July 2025.
